Contract for the provision of Afargram services
Edition of 23 October 2026.
1. General provisions
1.1. This document is a public offer by the sole proprietor (FOP) Obolonskyi Stefan Heorhiiovych (hereinafter the "Provider") to conclude a contract for the provision of services on the terms set out below, in accordance with Articles 633 and 641 of the Civil Code of Ukraine.
1.2. The contract is deemed concluded from the moment a person (hereinafter the "User") starts using the Service, that is, sends the bot the "start" command, connects a Telegram account or makes a payment.
1.3. If the User does not agree with the terms, the User must not use the Service.
2. Definitions
- "Service": the Afargram software service, which forwards messages between the User's Telegram account and the Transport chosen by the User.
- "Transport": the channel through which the User communicates with the Service: a WhatsApp bot and, once it is launched, a Viber bot.
- "Session": the Service's authorised access to the User's Telegram account; the User grants this access personally and may revoke it at any time.
- "Bot Message": one message that the Service sends to the User through the Transport.
3. Subject matter of the contract
3.1. The Provider grants the User access to the Service, which, on the User's commands, makes it possible to read and send the messages of the User's Telegram account through the Transport.
3.2. The list of features, their limitations for each Transport and the current tariffs are published on afargram.com.
3.3. The Service is an independent product. It uses the Telegram API and is not affiliated with or endorsed by Telegram, Meta, WhatsApp, Viber, SpaceX, Starlink or mobile network operators.
4. Who may use the Service
4.1. The Service may be used by a person who has reached the age of 18.
4.2. The User may connect only the User's own Telegram account. The phone number of that account must match the number from which the User contacts the Service through the Transport.
4.3. The Service is not provided to persons located in the countries and territories listed on afargram.com, in particular in the Russian Federation, the Republic of Belarus and the temporarily occupied territories of Ukraine.
4.4. The Service is not intended for the official communications of state authorities, military formations and critical infrastructure facilities.
5. Connecting a Telegram account
5.1. The User authorises the Session personally, in the same way as a sign-in on a new device. The Session is shown in the Telegram settings in the list of devices.
5.2. The User may terminate the Session at any time: by a command in the bot or in the Telegram settings.
5.3. The Service acts on behalf of the User only on the User's commands: it sends messages that the User has written personally and marks chats as read when the User has replied or opened the chat.
5.4. The Service does not support Telegram secret chats or calls.
6. What the Service does not guarantee
6.1. The operation of the Service depends on Telegram, Meta, Viber, telecommunications operators and the satellite network. The Provider does not control these systems.
6.2. The Provider does not guarantee the delivery of every message and does not guarantee the delivery time. Over a satellite connection, delays may reach minutes or more.
6.3. The Service is not an emergency alert system. The User must not rely on it as the only source of air raid alerts or of other information on which life and health depend.
6.4. Telegram, Meta or Viber may restrict the operation of the Service or of the User's account at their own discretion. The Provider is not liable for such actions.
7. Trial period
7.1. A new User is given a trial period: 72 hours from the moment the Service first serves the User with the User's Telegram account connected, or 100 Bot Messages, whichever comes first.
7.2. The trial period is given once per phone number.
8. Price and payment
8.1. After the trial period, the Service is provided on a prepayment basis at the tariffs published on afargram.com, for a month at a time. A paid month may include the number of Bot Messages stated in the tariffs for the Transport; when they are used up, the Service sends no more Bot Messages until the next payment, which adds the next number to those left.
8.2. Payment is accepted by the methods indicated on the website. In the bot, the User pays the first month on a page of monobank, by a link the bot gives; the card is saved at monobank and charged the same amount every month, a day before the paid month ends, until the User writes "stop paying" to the bot. Every payment gets a fiscal receipt, which the bot gives to the User.
8.3. When the paid time runs out, the Service continues to work on credit for 24 hours, because over a satellite connection the User may be unable to pay. The credit is deducted from the next payment: the paid time bought by it begins 24 hours earlier.
8.4. The User independently pays the cost of the operator's communication services to the User's own operator.
9. Refunds
9.1. The User may withdraw from the contract and receive back the unused paid balance by contacting support@afargram.com within 14 days from the day of payment.
9.2. Money paid for services already provided is not refunded.
9.3. If the Provider discontinues the Service, the Provider refunds the unused paid balance.
10. Obligations of the User
The User undertakes:
- to use the Service only for lawful purposes;
- not to connect other people's accounts and not to give third parties access to the Service;
- not to use the Service for sending spam or for automated mass actions;
- to comply with the rules of Telegram, WhatsApp and Viber;
- not to use the Service from the territories specified in clause 4.3.
11. Rights of the Provider
11.1. The Provider may suspend or terminate the provision of the Service to a User who breaches this contract.
11.2. The Provider may change the features of the Service and set limits on the number of messages and the volume of media.
11.3. The Provider may discontinue the Service altogether, giving at least 14 days' notice of this, if possible.
12. Liability
12.1. The Service is provided "as is".
12.2. The Provider is not liable for losses caused by the non-delivery or delay of messages, by the actions of Telegram, Meta, Viber or telecommunications operators, or by force majeure circumstances, in particular hostilities and outages of electricity and communications.
12.3. The Provider's aggregate liability to the User is limited to the amount that the User has paid over the last 3 months. This limitation does not apply where the law prohibits limiting liability to a consumer.
13. Personal data
The procedure for processing personal data is described in the Privacy Policy on afargram.com. The Privacy Policy is an integral part of this contract.
14. Changes to the terms and duration
14.1. The Provider may amend this contract. The Provider gives notice of the changes in the bot or on the website at least 10 days before they take effect.
14.2. If the User continues to use the Service after the changes take effect, the User agrees to them.
14.3. The contract is in force for as long as the User uses the Service. The User may terminate it at any time by disconnecting the Session and deleting the User's data with a command in the bot.
15. Governing law and disputes
15.1. The law of Ukraine applies to the contract. This does not deprive a consumer of the protection afforded to the consumer by the mandatory rules of the law of the consumer's country of residence.
15.2. Claims are sent to support@afargram.com. The Provider replies within 30 days.
